These Terms and Conditions apply to services provided by:

References to “we”, “us” or “Kilted Tours” mean Kilted Tours Ltd.

Our services

We offer:

  • Private guided walking tours
  • Self-guided GPS audio tours
  • VoiceMap tour-access codes

The relevant product or booking page will describe the tour, price, approximate duration, meeting point and main inclusions.

Making a booking or purchase

You are responsible for providing accurate:

  • Name
  • Email address
  • Mobile number
  • Number of participants
  • Number of access codes required
  • Booking information

Please check your details carefully. Incorrect contact information may delay the delivery of your confirmation or access code.

A contract is formed when we accept your order and send a booking or order confirmation.

We may refuse or cancel an order where:

  • Payment has not been authorised
  • The price or product information contains an obvious error
  • We reasonably suspect fraud or misuse
  • The service is unavailable
  • We cannot provide the requested tour

If we cancel after taking payment, we will refund the affected amount.

Prices and payment

Prices are shown in pounds sterling unless stated otherwise.

Payment is normally required at the time of purchase or booking.

Payments may be processed by Stripe, WooCommerce payment services, Bókun or another provider shown during checkout.

Self-guided audio tours

Our audio tours are delivered digitally through VoiceMap.

A purchase normally includes:

  • Access to the purchased GPS audio tour
  • One unique access code for each tour unit purchased
  • Redemption instructions
  • Offline access through the VoiceMap app, subject to VoiceMap’s functionality and terms

Admission to paid attractions is not included unless expressly stated.

The Voice of the Mile tour follows outdoor public streets. Optional attraction admission, transport, food and personal purchases are not included.

Multiple-code purchases

Where offered, customers may purchase between one and six access codes in a single order.

Each participant normally requires a separate VoiceMap code and compatible device unless the product description says otherwise.

Multiple codes may be displayed in the confirmation email with a separate redemption link for each code.

Codes must not be resold, copied publicly or shared beyond the number purchased.

Immediate digital delivery

Audio-tour codes are normally supplied immediately or shortly after payment.

The following wording should appear before the customer places the order:

☐ I agree to receive my audio tour and access code immediately.

By requesting immediate access, I understand that my 14-day cancellation right ends once the digital tour and access code have been supplied. This does not affect my rights if the tour is faulty or not as described.

UK rules require the customer’s agreement to immediate digital supply and acknowledgement that the normal cancellation right will be lost once supply begins. This information should also be included in the order confirmation.

This does not remove the customer’s statutory rights where the digital content is faulty, not as described or does not meet applicable consumer-law requirements.

Receiving and redeeming your code

Your code will normally be supplied through the website confirmation page or by email.

You may redeem the tour using the personalised VoiceMap link supplied with your code.

You may also redeem it manually in the VoiceMap app:

  1. Open the VoiceMap menu.
  2. Select Tour Codes.
  3. Enter the code supplied to you.

You are responsible for:

  • Providing a correct email address
  • Checking your spam or junk folder
  • Downloading the VoiceMap app
  • Using a compatible smartphone
  • Charging your phone before starting
  • Downloading the tour in advance where possible
  • Bringing suitable headphones
  • Following the route and local safety instructions

Missing or invalid codes

Contact info@kiltedtours.com if:

  • Your confirmation does not arrive
  • A code is missing
  • A code is rejected
  • You receive fewer codes than you purchased
  • You believe the code was already used before being supplied

Please include your name, order number and the affected code.

Where our records show that a valid code was not delivered correctly, we will resend or replace it as appropriate.

We are not responsible for a code that has been publicly shared, transferred without permission or redeemed by somebody to whom the purchaser gave access.

VoiceMap and third-party technology

VoiceMap is a separate third-party platform.

Use of the VoiceMap app is also subject to VoiceMap’s terms and privacy policy.

We will provide reasonable assistance with access-code problems relating to your purchase. However, we cannot guarantee uninterrupted operation of:

  • Third-party apps
  • Mobile networks
  • GPS services
  • Smartphone operating systems
  • Individual customer devices

This does not affect your statutory rights.

Private walking tours

Private walking tours are exclusively for the booked group unless otherwise stated.

Your confirmation will normally state:

  • Date and time
  • Meeting point
  • Approximate duration
  • Number of participants
  • Relevant booking instructions

Please arrive at least ten minutes before the scheduled starting time.

Contact us promptly if you are delayed.

A late arrival may result in a shortened tour where the guide cannot reasonably extend the finish time.

A group that does not attend and does not contact us may be treated as a no-show.

Private-tour cancellations

The cancellation policy displayed on the booking page or Bókun checkout at the time of booking forms part of the contract.

Please review the cancellation conditions before paying.

Where Kilted Tours cancels a private tour and cannot offer a suitable alternative, we will refund the amount paid for the affected tour.

We are not responsible for separate travel, accommodation, attraction or other expenses unless required by law.

Weather and route changes

Walking tours operate outdoors and normally continue in typical Scottish weather.

We may alter the route because of:

  • Unsafe weather
  • Road closures
  • Construction work
  • Police or council instructions
  • Festivals and public events
  • Restricted access
  • Security measures
  • Large crowds
  • Circumstances outside our reasonable control

A change to an individual stop or part of the route does not automatically entitle the customer to a refund where the main tour can still be delivered.

Accessibility

Edinburgh’s Old Town includes cobbles, steep slopes, kerbs, steps and uneven surfaces.

Please contact us before booking if someone in your group has a mobility or accessibility requirement that could affect participation.

We will provide honest information and make reasonable adjustments where practical, but not every route will be suitable for every participant.

Safety

Participants remain responsible for their personal safety and belongings.

Please:

  • Follow road and pedestrian rules
  • Remain aware of vehicles and cyclists
  • Avoid looking continuously at your phone while crossing roads
  • Wear suitable footwear and clothing
  • Follow reasonable instructions from the guide
  • Supervise children in your group
  • Avoid entering restricted, closed or unsafe areas

Audio-tour users should pause the recording whenever conditions require their full attention.

Conduct

We may refuse participation or end a private tour where a person:

  • Behaves abusively or threateningly
  • Harasses the guide or the public
  • Is dangerously intoxicated
  • Creates a serious safety risk
  • Deliberately damages property
  • Repeatedly refuses reasonable safety instructions

A refund will not normally be provided where a tour is ended because of serious customer misconduct.

Intellectual property

Tour recordings, scripts, photographs, maps, branding and written material are protected by intellectual-property law.

Your purchase gives you a personal right to use the tour for its intended purpose.

You must not:

  • Copy or distribute recordings
  • Republish tour material
  • Share access codes publicly
  • Resell access
  • Reproduce substantial parts of the tour
  • Use tour material commercially without written permission

Historical content

We aim to provide engaging and responsible historical information.

Historical sources can conflict, and some stories involve folklore, disputed accounts or traditional interpretations.

Tour content is provided for education and entertainment and should not be treated as academic, legal or professional advice.

Liability

Nothing in these Terms excludes liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Consumer rights that cannot legally be excluded

Subject to those protections, we are not responsible for losses caused by:

  • Failure to follow safety instructions
  • Incorrect customer information
  • An unsuitable or uncharged device
  • Failure to download the tour
  • Mobile-network or GPS problems
